Terms & Conditions

Welcome to ParkClear! By accessing or using the ParkClear mobile application (the “App”) or our website (https://parkclear.co), you agree to comply with and be bound by these Terms and Conditions (the “Terms”). These Terms govern your use of the App, website, services, and content. If you do not agree, you must discontinue use immediately.

  • Definitions

  • Parking: The act of stopping and leaving a vehicle in a location, either temporarily or for an extended period.
  • App: The ParkClear mobile application, including all software, features, services, and content provided within it.
  • GPS Data: Location-based data collected from a user’s mobile device through the ParkClear App to determine real-time positioning, verify app usage, assess compliance with parking guidance, and confirm activity. This data may be used to improve service accuracy, subject to the terms outlined in the Privacy Policy.
  • User: Any individual who downloads, accesses, or uses the ParkClear App or website.
  • Subscription: A recurring paid plan that grants access to features, including but not limited to ad removal, subject to eligibility criteria and exclusions outlined in these Terms.
  • ParkClear Guidance: Parking recommendations provided through the App based on available data, regulations, and user input.
  • Non-Physical Signage: Parking restrictions, notices, or regulations displayed electronically or digitally, including curb markings, in-ground indicators, or app-based permits, rather than traditional posted signs.
  • Physical Signage: Any tangible, posted sign that communicates parking restrictions, regulations, or instructions, typically installed by local authorities, private property owners, or other authorized entities.
  • Physical Government-issued Street Signage: Government-issued, publicly displayed signs that indicate parking rules, restrictions, and limitations for designated areas on public streets, typically enforced by municipal or state authorities.
  • Ads: Commercial or promotional content displayed within the App.
  • Trial Period: The 30-day ad-free period granted to new users starting from their first use of the App. 

2. Acceptance of Terms

By downloading, installing, or using the ParkClear App or website, you confirm that you have read, understood, and agree to these Terms and Conditions as well as our Privacy Policy. ParkClear may update these Terms from time to time, and any modifications will be communicated via the App, email, or other reasonable means. Changes become effective no earlier than 14 days after posting, except for legal compliance or security updates, which take effect immediately. Continued use of the App after such updates constitutes acceptance of the revised Terms.

3. Eligibility

The App is intended for individuals aged 16 and older. Users under 18 may only access and use the App with the consent and supervision of a parent or legal guardian. By using the App, you represent and warrant that you meet this eligibility requirement, and if under 18, that your parent or legal guardian has agreed to these terms on your behalf.

We reserve the right to request proof of age or guardian consent at any time. If we determine that a user does not meet the eligibility requirements, we may suspend or terminate access to the App without notice.

4. User Accounts

To access or use the App, you must create an account and agree to:

  • Provide accurate, complete, and current information.
  • Update your information as needed to keep it current.
  • Maintain account security and confidentiality of login credentials.
  • Notify ParkClear immediately of any unauthorized access or security breaches.
  • Accept full responsibility for all activity that occurs under your account.

ParkClear is not liable for unauthorized use of an account due to a user’s failure to maintain security.

5. Service Models

5.1 Non-Subscription Model

ParkClear provides a free, ad-supported version of the App, allowing users to access core parking assistance features at no cost. However, an upgraded subscription is required to remove ads and unlock premium features.

5.2 Subscription Model ParkClear Plus

Payments for app services and features are non-refundable unless explicitly stated otherwise. 

Automatic Renewal & Billing

  • Subscription will automatically renew at the end of each billing cycle at the then-current price unless canceled at least 24 hours prior to the renewal date. Cancellations can be made through the App settings or by contacting customer support. 
  • It is your responsibility to manage and cancel your subscription in a timely manner to avoid unwanted charges. Recurring subscription payments are non-refundable, except where explicitly stated otherwise. If there are any changes to subscription pricing, ParkClear will provide you with at least 30 days’ advance notice before the new rates take effect.

5.3 30-Day Ad-Free Trial

New users of the ParkClear App are eligible for a 30-day ad-free trial period starting from the date of their first app use. During this trial, users can enjoy the full app experience without advertisements.

After the 30-day trial ends, the app will display ads during use unless the user subscribes to ParkClear Plus or another ad-free subscription plan. By continuing to use the app after the trial period, you acknowledge and accept the introduction of ads. Each user account is eligible for the 30-day trial only once. This trial cannot be combined with other promotions or extended. ParkClear reserves the right to modify or discontinue the trial offer at any time without prior notice.

5.4 Data Use and Privacy

Please note that the collection, use, and sharing of your data in connection with advertisements and app features are governed by our Privacy Policy, which you should review carefully to understand how your information is handled.

6. Use of the App

By using the App, users agree to engage only in lawful activities and refrain from:

  • Violating any local, state, federal, or international regulations.
  • Disrupting the functionality or security of the App.
  • Transmitting or facilitating the distribution of unsolicited advertisements or promotional materials, including “junk mail,” “chain letters,” “spam,” or similar solicitations.
  • Impersonating or attempting to impersonate ParkClear, its employees, other users, or any other individual or entity.
  • Misrepresenting their identity, submitting fraudulent claims, or manipulating system data.
  • Accept the display of advertisements after any applicable trial period unless you have an active ad-free subscription.

7. Prohibited Activities & Misuse

By using the ParkClear App, you agree not to engage in any actions that could be deemed abusive, harmful, or disruptive to the App, its services, or its users. Any violation of this section may result in legal action to the fullest extent of the law. Prohibited activities include, but are not limited to:

  • Unauthorized Access: Attempting to access restricted areas of the App, other user accounts, or connected systems through hacking, password mining, or any other unauthorized methods.
  • Disruption of Service: Interfering with or compromising the security, integrity, or functionality of the App or its services, including the use of automated scripts, bots, or any other tools designed to manipulate the App’s operations.
  • Misuse of Information: Using any data obtained from the App for commercial purposes without explicit written consent, including selling, distributing, or exploiting such information.
  • Harassment & Abuse: Engaging in harassment, abuse, intimidation, or creating a hostile environment for other users, including sending unsolicited messages.
  • Providing False Information: Submitting inaccurate, misleading, or fraudulent data, such as falsifying parking details, contents, images, uploads, or misrepresenting identity.

ParkClear reserves the right to suspend or terminate accounts involved in:

  • Unauthorized access to systems or networks.
  • Fraudulent claims or manipulation of the service.
  • Misuse of the App for purposes beyond its intended function.

8. Intellectual Property Rights

ParkClear retains full ownership of all proprietary technology, patents, trademarks, and content, including but not limited to text, graphics, logos, and software. Any unauthorized reproduction, modification, distribution, or creation of derivative works based on the App’s content without our express written consent is strictly prohibited.

By submitting content to ParkClear, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, publish, and distribute that content across any media. You affirm that you own or have the necessary rights to the content you submit and that it does not infringe upon any third-party rights.

9. Disclaimers of Warranties and Limitation of Liability

ParkClear provides general parking assistance but does not guarantee that users will avoid parking tickets. The ParkClear App and all information provided through it are made available “AS IS, ”WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The information provided through the App is for general informational purposes onlyParkClear does not warrant or guarantee the accuracy, completeness, reliability, or usefulness of any information provided, including “Yes” or “No” answers regarding parking availability. Since parking data is contributed and uploaded by users, it may be subject to errors, delays, inaccuracies. Additionally, this information may be affected by factors beyond ParkClear’s control, such as internet transmission issues, interruptions, limitations or third-party data inaccuracies. Users should exercise their own judgement and verify parking regulations independently to avoid fines or penalties. 

By using the ParkClear App, you acknowledge and agree that any reliance on the provided information is solely at your own risk. ParkClear is not responsible for any errors, inaccuracies, or omissions in the information provided, nor for any decisions or actions taken based on such information.

ParkClear is not responsible for any issues arising from advertisements displayed within the App, including but not limited to interruptions, content accuracy, or third-party links. Ads are provided by third-party partners, and ParkClear does not endorse or guarantee any products or services advertised.

To the maximum extent permitted by law, ParkClear shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including, but not limited to, losses resulting from system failures, data breaches, service interruptions, or other events beyond ParkClear’s control.

10. Indemnification

Users agree to indemnify, defend, and hold harmless ParkClear, along with its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, suppliers, successors, and assigns, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or related to:

  • Violation of these Terms by the user.
  • Misuse of the App, including fraudulent, unauthorized, or unlawful activities.

This indemnification obligation applies to any claims brought by third parties and extends to all expenses incurred by ParkClear in defending such claims.

11. Dispute Resolution & Arbitration

  • Mandatory Arbitration: Any dispute arising out of or relating to these Terms shall be resolved exclusively through binding arbitration, and both parties expressly waive the right to a jury trial. Arbitration will take place in Los Angeles, California, unless the parties mutually agree to an alternative venue.
  • Pre-Arbitration Notice: Users must notify ParkClear in writing before initiating arbitration and attempt informal resolution.

12. Governing Law

These Terms are governed by the laws of the State of California, except where local consumer protection laws in the user’s jurisdiction provide additional rights that cannot be waived.

13. Termination of Service

ParkClear reserves the right to suspend or terminate accounts at its discretion, particularly for:

  • Repeated violations of these Terms.
  • Fraudulent activity or misuse of services.

14. Changes to Terms

ParkClear may modify these Terms and Conditions at any time to reflect changes in our services, legal requirements, or business practices. When we make changes, we will post the updated Terms on this page and notify you through the App, email, or other reasonable means.

Except for changes required for legal compliance or security reasons, updates to these Terms will become effective no earlier than 14 days after posting. This notice period gives you time to review the changes before they take effect

By continuing to use the ParkClear App or website after the updated Terms become effective, you agree to be bound by the revised Terms. If you do not agree with any changes, you must discontinue use of the App immediately.

15. Apple Login Service

ParkClear offers users the option to sign in using Apple’s Login service, designed with your privacy and convenience in mind. When you choose to log in with Apple, please note the following:

  • The login service collects only your name and email address.
  • You have the option to keep your email address private when setting up your account.
  • The login service does not collect data about your interactions with ParkClear for advertising purposes without your explicit consent.
  • Your primary account is the one you establish with ParkClear to identify yourself, sign in, and access our features and services.

Please be aware that Apple Login is provided as an option and is not mandatory if:

  • You prefer to use ParkClear’s own account setup and sign-in system exclusively.
  • You are using an alternative app marketplace or an app distributed from one that requires marketplace-specific login credentials.
  • You are accessing ParkClear as part of an education, enterprise, or business environment that requires sign-in with an existing institutional account.
  • You authenticate using a government or industry-backed citizen identification system or electronic ID.
  • You are using ParkClear as a client for a specific third-party service that requires direct sign-in to that service.
